OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE.
Under Maryland law, a member or manager of an LLC is not personally liable for any debt, obligation, or liability of the LLC solely by reason of being a member or manager. The liability shield afforded to NC-Developer, LLC under Maryland law applies to all claims arising from the operation of the Healthy-E Store.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
Before initiating formal proceedings, you agree to contact us at support@nc-devs.com to attempt to resolve any dispute informally. We will respond within 30 days.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the State of Maryland. You consent to the personal jurisdiction of such courts.
Nothing in these Terms limits your rights under the Maryland Consumer Protection Act (Md. Code Ann., Com. Law §§ 13-101 to 13-501) or your right to file a complaint with the Maryland Attorney General's Consumer Protection Division. These statutory rights cannot be waived by contract under Maryland law.
Notwithstanding the above, either party may bring an individual action in Maryland District Court small claims court for disputes within that court's jurisdictional limit.
We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
